1. Agreement to Terms

By accessing or using ColdDMGenerator.io ("the Service"), operated by Bomerang LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

ColdDMGenerator.io is a web-based tool that generates personalized cold outreach messages for various platforms including Instagram, LinkedIn, Twitter, and Email. Users input their target niche and outreach goal, and the Service generates message variants for their use.

3. User Accounts & Credits

  • Free Tier: Users receive 3 free message generates (9 total messages) without requiring an account.
  • Pro Plan ($19/month): Provides 100 generates per month (300 messages), message saving, history, and priority generation.
  • Agency Plan ($79/month): Provides unlimited generates, team seats (up to 5), CSV export, white-label option, and priority support.
  • Credits do not roll over from month to month for paid plans.
  • We reserve the right to modify pricing with 30 days' notice to existing subscribers.

4. Payment & Billing

  • Paid subscriptions are billed monthly on the date of initial purchase.
  • Payments are processed securely through our third-party payment processor.
  • All fees are in US Dollars (USD) and are non-refundable except as described in Section 5.
  • You are responsible for providing accurate and current billing information.

5. Refund Policy

We offer a 7-day money-back guarantee for first-time subscribers. If you are not satisfied with the Service within 7 days of your initial subscription, contact us at support@bomerang.io for a full refund. Refunds after the 7-day period are not available. Renewals are non-refundable.

6. Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to your paid plan features until the end of your current billing period. After that, your account will revert to the Free Tier.

7. Acceptable Use

You agree NOT to use the Service to:

  • Generate spam, harassment, or unsolicited bulk messages in violation of applicable laws (including CAN-SPAM, GDPR, etc.).
  • Impersonate another person or entity.
  • Generate content that is illegal, defamatory, threatening, or infringes on intellectual property rights.
  • Attempt to reverse-engineer, scrape, or automate access to the Service beyond normal use.
  • Resell or redistribute generated messages as a competing service without an Agency plan.

You are solely responsible for how you use the generated messages. We do not guarantee any specific results, reply rates, or outcomes from using the messages.

8. Intellectual Property

  • The Service, including its design, code, templates, and branding, is owned by Bomerang LLC.
  • Messages generated by the Service are yours to use freely for your outreach purposes.
  • You may not claim ownership of the Service's underlying technology or templates.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

  • The Service will be uninterrupted or error-free.
  • Generated messages will achieve any specific results or reply rates.
  • The Service will meet your specific requirements.

10. Limitation of Liability

To the maximum extent permitted by law, Bomerang LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email to paid subscribers.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
